SNOCAP, Inc. Use Terms

“Use Terms” are licensing and use rules that a copyright holder sets with respect to its content and which govern the use of such content. The following Use Terms shall govern your rights with respect to all digital files of content (including, but not limited to, digital downloads whether such downloads are permanent, tethered, or limited time or play duration, as well as the images, and likenesses of persons, software, text, and video clips (individually and collectively, the “Content”)) that you access by means of the SNOCAP store(s) and services. Content may be used only in accordance with the following, applicable Use Terms.

I. Use Terms for Content in MP3 Format

You may use Content as follows, but, in all instances, for personal use only.

You may play Content an unlimited number of times.

You may not: 1) play and then re-digitize any Content; 2) upload the Content to the internet; 3) use the Content in conjunction with any other third-party content (e.g., to provide sound for a film); 4) use any Content for promotional purposes; 5) publicly perform the Content; 6) sell or offer to sell the Content; 7) redistribute the Content including but not limited to, posting any Content for auction on any internet auction site; 8) reverse engineer, decompile, translate, adapt, disassemble or otherwise tamper with the Content or circumvent any technology designed to enforce the Use Terms; and 9) attempt to modify the Content or the Use Terms for any reason whatsoever, including for the purpose of disguising or changing ownership of the Content.

Additionally, you must comply with all applicable laws in your use of Content.

Re-Installs to a Personal Computer

To handle customer support issues (e.g., when you upgrade your operating system or have a hard-drive crash), customer service agents of SNOCAP may in their reasonable discretion permit one (1) re-install to your personal computer.

II. Use Terms for Content in WMA Format Sold Through SNOCAP MyStores

You may use Content as follows, but, in all instances, for personal use only.

You may play Content an unlimited number of times.

You may not: 1) reproduce the Content, except as detailed in this Section II; 2) play and then re-digitize any Content; 3) upload the Content to the internet; 4) use the Content in conjunction with any other third-party content (e.g., to provide sound for a film); 5) use any Content for promotional purposes; 6) publicly perform the Content; 7) sell or offer to sell the Content; 8) distribute or redistribute the Content including but not limited to, posting any Content for auction on any internet auction site; 9) reverse engineer, transcode, decompile, translate, adapt, modify, disassemble or otherwise tamper with the Content or circumvent any technology designed to enforce the Use Terms; and 10) attempt to modify the Content or the Use Terms for any reason whatsoever, including for the purpose of disguising or changing ownership of the Content.

Additionally, you must comply with all applicable laws in your use of Content. For the sale of clarity, reproduction (except to the extent authorized in this Section II) or distribution of Content violates Federal copyright law.

CD Burning From a Personal Computer

You may not burn a particular playlist to a CD more than seven (7) times. Burns of a single-track Content to a CD are permitted, but you may not burn any Content more than ten (10) times, whether as a single-track or as part of multiple playlists. The playlist burn restrictions set forth above are absolute and may not be evaded through creation of new playlists containing identical musical content or otherwise. For the avoidance of doubt, an album shall be deemed a playlist hereunder.

Re-Installs to a Personal Computer

To handle customer support issues (e.g., when you upgrade your operating system or have a hard-drive crash), customer service agents of SNOCAP may in their reasonable discretion permit one (1) re-install to your personal computer.

Personal Computers

You may activate each purchased Content on up to five (5) personal computers.

Portable Devices

You may transfer Content from personal computers to portable devices with security set at a level no less than “1000.” You may export Content to no more than three (3) portable devices.
