1. Introduction.
We believe you have the right to know our practices regarding the information we may collect when you visit the SNOCAP Website or use our Service. This Privacy Policy tells you how we use and protect your personal information. It applies to SNOCAP, the Service and SNOCAP Customer Service. Other participating websites and third party sites which are linked to/from the Service and entities that are co-branded with us may have different privacy policies, and we encourage you to read these policies. All capitalized terms herein are defined when first used or in Paragraph 11. By accepting any End User License Agreement ("EULA"), Terms of Service or Terms of Use concerning the Service which refer to and incorporate the terms of this Privacy Policy, you accept this Privacy Policy and fully understand and unambiguously consent to the collection and processing of any information you provide to us.
2. Information You Give Us.
In order to use some of the Service, including the purchase of music, we may ask you to provide "Personal Information.” Personal Information includes: your e-mail address, name, mailing and/or billing address, telephone number, mobile phone number and/or credit card number and expiration date.
3. Information We Collect.
We may use “cookies,” “Web Beacons,” and/or similar technologies to collect and maintain information in relation to the Service, advertisements thereon, and the Software. These technologies may store information on your computer and allow us to customize your experience to better match your interests and preferences, optimize the Service, or to simply facilitate your signing in to use the Service.
4. Sharing Your Personal Info.
We may share your personal information or other information as may be required by law, legal process or court order, to protect the personal safety or property of you, our users, the public, our licensors or ourselves, and as may be required to respond to an inquiry, request or complaint you have made (such as with SNOCAP Customer Support). We may also share your personal information or other information with our affiliates (entities which control, are controlled by or are under common control with us) who may want to contact you about products, services or other offerings that may be of interest to you. Information collected or provided using a portion of the Service which is co-branded by us and a third party may be shared by us with that third party without express notice. Our third party co-branded partners will not contact you with commercial messages unless you instruct otherwise through an opt-in or opt-out mechanism. Additionally, with your consent, we may share your personal information or other information with specific third parties other than our affiliates who may want to contact you about products, services, promotions or other offerings that may be of interest to you. See Paragraph 8 for information about changing your email preferences.
5. Anonymous / Aggregated Info.
We may share anonymous and/or aggregate information about our visitors with advertisers, business partners, affiliate marketing companies sponsors and other third parties. We are required to provide anonymous reports to our licensors and owners of content available at the Service, concerning downloads, burns, transfers, preview clips and other information related to user activity. The main purpose of these reports is to ensure proper royalty payments by us to our licensors and owners.
6. No Spam Policy.
We and our users hate spam e-mail. Please set your notification preferences so that our communications with you are limited to your preferences. Unless you instruct us otherwise, we may contact you with commercial information about products, services, promotions, contests or other activities or offerings that may be of interest to you. Also, we may contact you to provide you with information concerning your SNOCAP Account, your transaction(s) with us, your use of the Service, Service announcements, Service and Software updates and changes to our terms of service, this Privacy Policy or other similar items, without your specific consent.
7. Other Communications.
The Service may have certain features that allow you to send information to others (such as a "Tell a Friend" feature or a SNOCAP gift certificate feature). In certain circumstances, such as when we receive specific complaints related to a particular message or when we are compelled to do so by law, we reserve the right to monitor messages sent via the Service, such as to check for abusive language or infringing content, and may alter or block such messages. Also for administrative purposes, we will keep a mail log that will include a record of which users sent messages and to which users or email addresses they were sent.
8. Security and Access.
We take great care in maintaining the security of your Personal Information, and preventing unauthorized access to it. We protect your information using commercially reasonable technology and internal procedures. For example, your information which is stored and transmitted by us is protected by SSL (Secure Socket Layer) encryption. Although we work hard to protect your Personal Information, as you know, we cannot guarantee that unauthorized access will never occur.
9. Changing Your Personal Information.
You can see, review, change, and delete most of your Personal Information by logging into the "SNOCAP Account" section of the SNOCAP Website. Please note that we may be prohibited from deleting certain of your Personal Information due to an applicable court order, statute, law or regulation. Also, please note that you may need to communicate directly with the entities described in Paragraph 4, such as third parties with whom you gave us consent to share your Personal Information, if you no longer wish to receive their communications or need to change or delete any information you supply.
10. Changing This Privacy Policy.
We may amend this Privacy Policy at any time by replacing the "Privacy Policy" link on the home page of the SNOCAP Website with a link entitled "Privacy Policy Updated XX/XX/XXXX." We may also send you an email indicating that we have updated this Privacy Policy. Amended terms automatically take effect thirty (30) days after they are initially posted.
11. Definitions.
“Privacy Policy” refers to this privacy policy, which may be amended from time to time by us in accordance with Paragraph 10.
“Service” refers to: (i) the SNOCAP Website, (ii) online stores branded, co-branded, and/or enabled by us, such as “SNOCAP MyStores,” (iii) any content on, or services related to, the SNOCAP Website and online stores branded, co-branded, and/or enabled by us, and (iv) Software.
“Software” refers to the software application and all updates thereto owned by or licensed to us, which provide access to the Service once installed to the hard drive of your personal computer (including automatic updates to the such software, which may be installed to your personal computer by the Service without further notice) and any security components that permit digital files to be used only as permitted by the terms of any applicable EULA and usage rules set by us and/or our licensors.
“SNOCAP,” “We,” “Us,” and “Our” refer to SNOCAP, Inc. (or a subsequent owner or operator of the Service if we or one of our companies assigns our rights and obligations regarding any of your information at the time of a merger, acquisition, or sale of all or substantially all of our assets related to the applicable site or service to a subsequent owner or operator).
“SNOCAP Account” means a user account registered with the Service.
“SNOCAP Customer Service” refers to the customer service available to you concerning the Service. For certain portions of the Service when you contact SNOCAP Customer Service, you may be contacting customer service representatives of companies that we have engaged to provide support for those portions of the Service.
“SNOCAP Website” refers solely and collectively to our web site currently located at http://www.snocap.com, and any successor web site.
